The terms governing PodDrop services

Use of the site constitutes acceptance of these Terms & Conditions, the Privacy Policy, Shipping Policy, Refund Policy, Live Arrival Policy, and any additional terms shown at checkout or attached to a professional account. If you do not agree, do not use the site or purchase products.

You must be at least 18 years old or use the site with the involvement and consent of a parent or legal guardian. You may use the site only for lawful purposes and in compliance with applicable possession, transport, import, animal-health, environmental, and commercial rules.

PodDrop works to describe product identity, size, format, handling, and intended applications accurately. Images may be representative, and the appearance, activity, color, density, life-stage distribution, and settling of a living culture can vary by batch and transit conditions.

Unless a written product specification states otherwise, a product is not represented as axenic, sterile, pathogen-free, clonal, genetically authenticated, or certified to an analytical count or concentration.

Customer systems differ in salinity, temperature, filtration, livestock, competition, predation, feeding, acclimation, maintenance, and other conditions. PodDrop does not guarantee establishment, reproduction, persistence, coral growth, fish health, water-quality changes, culture yield, research results, or any other downstream outcome.

An order submission is an offer to purchase. PodDrop may accept, decline, hold, limit, or cancel an order because of culture availability, destination restrictions, suspected fraud, pricing error, payment issue, unsafe shipping conditions, or another operational or legal concern.

Order confirmation does not guarantee a particular ship date. PodDrop will not substitute a different live species without customer approval.

Prices are shown in the currency selected on the site and may change without notice. Payment must be authorized before fulfillment. Applicable shipping charges, taxes, discounts, and promotional terms are shown at checkout.

The customer is responsible for duties, brokerage, import charges, permits, and other destination costs unless expressly included. PodDrop may correct a pricing or promotional error before fulfillment.

Live orders are processed under the Shipping Policy. Transit services and delivery dates are estimates. The customer must provide an accurate, accessible address, monitor tracking, retrieve the package at the first delivery attempt, and follow the product-specific receiving directions.

International availability and risk are further limited by carrier service, customs, inspection, and destination rules.

Live-arrival concerns are governed by the Live Arrival Policy, including its 2-hour reporting window, documentation requirements, review process, and exclusions. Living products cannot be physically returned. Cancellations, credits, and other resolutions are governed by the Refund Policy.

When an eligible product is purchased on a recurring plan, the customer authorizes repeat billing at the price and frequency presented at sign-up, subject to the Subscription Policy. Each processed shipment remains subject to the live-product shipping and arrival policies.

You are responsible for safeguarding account credentials and keeping contact, payment, shipping, tax, resale, and organizational information accurate. Notify PodDrop promptly of suspected unauthorized account use.

Professional-account approval, pricing, credit, minimums, documentation, and supply availability may change or be withdrawn.

Quotes, purchase orders, specifications, recurring schedules, documentation commitments, and account terms are not binding until accepted by PodDrop in writing. A written supply agreement or accepted quote controls where it conflicts with these general storefront terms.

The customer remains responsible for validation, experimental controls, biosafety review, permits, receiving procedures, and fitness for the intended protocol.

The customer is responsible for determining whether a species may lawfully be purchased, imported, possessed, transferred, cultured, released, or used at the destination. Live cultures must not be released into natural waterways or the environment.

PodDrop may decline or cancel an order when destination eligibility, permitting, carrier acceptance, or regulatory compliance cannot be reasonably confirmed.

Site text, photographs, graphics, product presentation, educational materials, logos, and original design elements are owned by PodDrop or used with permission. Limited personal, noncommercial reference use is allowed. Reproduction, resale, scraping, republication, or commercial use requires written permission unless applicable law provides otherwise.

You may not interfere with site operation, attempt unauthorized access, introduce harmful code, misuse forms, submit false account or claim information, infringe intellectual-property rights, harvest data, impersonate another person, or use the site or products for an unlawful purpose.

The storefront may use or link to third-party payment, subscription, review, analytics, social, shipping, and other services. Their availability and practices are governed by their own terms. PodDrop is not responsible for third-party websites or services outside its control.

To the maximum extent permitted by law, the site, content, and products are provided without warranties beyond those expressly stated in writing. PodDrop is not liable for indirect, incidental, special, consequential, exemplary, or downstream damages, including livestock loss, lost production, lost data, or lost profit.

To the maximum extent permitted by law, PodDrop’s aggregate liability related to an order will not exceed the amount paid for the affected product. Rights that cannot lawfully be excluded remain unaffected.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless PodDrop and its personnel from claims, losses, liabilities, and reasonable costs arising from unlawful use of the site or products, violation of these terms, infringement of another party’s rights, or failure to comply with applicable requirements.

These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. If a provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect.

PodDrop is not responsible for delay or failure caused by events beyond reasonable control, including severe weather, natural disaster, fire, utility or internet interruption, labor or carrier disruption, government action, epidemic, supply interruption, civil disorder, or another event that prevents normal production or fulfillment.

By using the site, creating an account, or placing an order, you consent to receive transactional communications electronically, including confirmations, payment notices, tracking, policy notices, and service messages. You are responsible for maintaining a monitored email address and current contact information.

These terms, the incorporated policies, checkout disclosures, and any accepted written professional terms form the agreement for the applicable service or order. Failure to enforce a provision is not a waiver. You may not assign your rights or obligations without PodDrop’s written consent; PodDrop may assign them as part of a reorganization, financing, sale, or transfer of its business or assets.

PodDrop may revise these terms as the site, products, services, or legal requirements change. The current effective date appears above. Continued use after an update constitutes acceptance of the revised terms.
